1. Who We Are and Acceptance of the Terms

El Plato Seguro is operated by DCS LLC (the trade name under which the owner provides this service as an independent professional), with an operating address in Estonia.

By accessing, subscribing to, or using the El Plato Seguro web application or landing page, you accept these Terms & Conditions. If you do not agree with any provision, you should refrain from using the platform.

2. Medical and Health Disclaimer

• El Plato Seguro is a digital wellness, nutrition education, and culinary recipe platform based on low glycemic load principles.
• We are not a medical facility: neither the platform's content, nor the recipes, nor interactions with Clara AI constitute medical advice, diagnosis, or treatment prescriptions for Type 2 Diabetes, Prediabetes, Insulin Resistance, or any other condition.
• Never stop or change your medication: users with type 1 diabetes, type 2 diabetes, prediabetes, or any other medical condition must consult their treating physician before making any changes to their medication, treatment, or lifestyle. Clinical monitoring of your condition is the sole responsibility of you and your medical team, never of El Plato Seguro.

3. Responsibility Regarding Artificial Intelligence, Allergens, and Cross-Contamination

• The Nutritional Scanner and the Clara Assistant are GUIDANCE tools based on artificial intelligence, with a known margin of error: they may not correctly detect every ingredient in a dish, especially hidden sugars, flours, or starches in preparations they don't recognize.
• Allergens and cross-contamination: the platform does not guarantee the detection of allergens (nuts, gluten, dairy, shellfish, etc.) nor possible cross-contamination in food preparation. If you have any known allergy or intolerance, it is your responsibility to verify the ingredients yourself before consuming any dish.
• The user is solely responsible for verifying that cooked or consumed ingredients do not conflict with known allergies, intolerances, personalized dietary prescriptions, or specific medical guidance.

4. Subscription, Payments, and Billing with Hotmart

• All charges, billing, currency conversion, and taxes are securely processed by Hotmart B.V. as the Merchant of Record.
• Subscriptions (monthly or annual) renew automatically unless you decide to cancel before the billing date.
• You can cancel automatic renewal at any time and without penalties from your Hotmart user panel or by requesting it from our support team.
• The 15-day refund guarantee is governed by the Guarantee & Refund Policy, aligned with the withdrawal window configured in Hotmart.

5. Intellectual Property and License to Use

• All recipes, text, dish photographs, trademarks, badges, and downloadables (such as PDF books and certificates) are the exclusive property of El Plato Seguro.
• Users are granted an individual, personal, non-transferable license for household use. Unauthorized reproduction, sale, or distribution of any material is prohibited.

6. Limitation of Liability

• The service is offered "as is" and "as available," with no guarantee that it will be uninterrupted or error-free.
• The guidance generated by Clara AI and the Scanner is GUIDANCE, not medical advice, professional nutritional advice, or any other binding advice. Users are responsible for their own health and dietary decisions.
• To the fullest extent permitted by applicable law, DCS LLC will not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the platform, including allergic reactions, effects on metabolic health, or decisions made based on the content or the AI's responses.

7. Governing Law and Dispute Resolution

These Terms are governed by the laws applicable in Estonia, DCS LLC's country of operation, without prejudice to any rights that your country of residence's consumer protection laws grant you on a mandatory basis. Any dispute will first be attempted to be resolved directly by writing to elplatoseguro@gmail.com.
